Congratulations, Bhumireddy Sai Srinivas Reddy!
It is a matter of immense pride for the entire Telugu community that our own TNSF Andhra Pradesh State Vice President, a native of Pulivendula, has officially taken his oath as a licensed Attorney in the State of Indiana, USA at just 25 years of age, on his very first attempt!
What makes this even more special is that he is now dual licensed in both India and the USA at just 25 a truly rare and remarkable achievement!
New Fraud Alert ‼️
@amazonIN started a new fraud by not refunding amount for returned items. Here is my case where I have returned a product and waited so long for refund. As I enquired for refund they calmly said you returned a wrong product and refund can’t be processed.
@AmazonHelp@amazonIN@jagograhakjago DM settings are now updated. DM me if you really want to know the details. I heard of issues where you ask to DM and never respond.
I do not think that Chandra Babu will ever stoop to the level of Lalu and company and steal from public funds. He is one of the few visionary and go getter politicians we have. Pity that sheer political vendetta is playing out to malign and harass a good politician. This will boomerang big time on YSRP.
Sri #ncbn has been remanded to the judicial custody and lodged in the Central Prison, Rajamahedravaram as per orders dated 10-9-2023 of Hon'ble Court of Special Judge for SPE & ACB Cases, Vijayawada (AP) in Crime No. 29/2021 of CID PS, AP, Mangalagiri.
I have read the Remand Application of the IO submitted to the Court which is in circulation in social media. As read therein, #ncbn did take certain decisions about skill development matters in his official capacity as CM of AP. Therefore, fulfilling the requirement of previous approval of @governorapsection asunder 17A of PC Act is mandatory.
The rest of the contents of the Remand Application are boringly repetitive verbose allegations that must have strained the creative writing abilities of the police officers concerned, which may be characterised as Cock & Bull Stories or కాకమ్మ కబుర్లు bereft of any evidence of criminal misdemeanour or malfeasance on the part of #ncbn.
As regards applicability of section 17A of Prevention of Corruption Act, 2018, a screenshot of page-15 of the remand order of the Hon'ble Court is shared👇hereunder as attachment (1st one).
There seems to be typographical error in the order as the citation Kinjarapu Atchennaidu Vs. State of A.P. in 2020 SCC online AP 533 relates to the Judgement of the Hon'ble High Court of Andhra Pradesh, and NOT of the Apex Court.
The citation Yashwant Sinha and others Vs. Central Bureau of Investigation in 2020 (2) SCC 338, is a decision of Hon'ble Supreme Court. In this case the Petitioners approached the Hon'ble SC praying for direction to the CBI to register a PE or an FIR and take up enquiry or investigation on their allegations of corruption etc in purchase of Rafale Fighter Jets. The Hon'ble SC dismissed their plea.
Importantly, in Paras 83 to 86 of the said Judgement (screenshots shared herewith as 2nd, 3rd and 4th attachments👇), Hon'ble Justice K. M. Joseph has dealt with the matter regarding applicability of section 17-A of P C Act with regard to allegations of corruption in Rafale case, the agreements for which were entered into by the Indian and French Governments prior to the enactment of the Prevention of Corruption (Amendment) Act, 2018, that is prior to section 17A.
Hon'ble Justice K. M. Joseph had also ruled in the penultimate Para-86 of the Judgement that it "would not stand in the way of the first respondent (CBI) in Writ Petition (Criminal) No. 298 of 2018 from taking action on Exhibit P1-complaint in accordance with law and subject to first respondent obtaining previous approval under Section 17A of the Prevention of Corruption Act."
The reason is evident from a simple reading of Section 17A. It does not talk about the date of occurrence of alleged crime under the P C Act; it only imposes complete ban on the police officer's power to enquire or inquire or investigate, without the prior approval of the competent authority mentioned therein, into certain offences under the P C Act irrespective of the date of commission of those offences. Hence, any discussion of its prospective or retrospective application is inane and against its letter and spirit.
As such, the Hon'ble SC has rightly ruled that section 17A of PC Act is applicable even in alleged offences under P C Act that occurred even prior to its enactment in 2018.
Therefore, in my humble considered view it is erroneous to cite the aforementioned judgement of Hon'ble SC and make an inference totally contrary to its decision.
I hope the learned advocates appearing for @ncbn will take of notice it and submit to the Appellate Court appropriately.
Heart touching messages pouring in for you and CBN garu. You are an extraordinary human with an ability to face any kind of adversity. You are only getting stronger day by day. Your strength is exponentially increased in the last 48 hours. From what I sense about you and CBN garu, this situation and crises make you stronger and gather more mass. I write to you today with a heart heavy with pain and eyes moistened with tears. I've grown up watching my father pour his heart and soul into the betterment of Andhra Pradesh and the Telugu people. He never knew a day of rest, tirelessly striving to transform millions of lives. His politics have always been marked by dignity and honesty, and I've witnessed the deep inspiration he drew from the love and gratitude of those he served. Their heartfelt thanks filled him with pure joy, akin to a child's delight.
I, too, drew inspiration from his noble path and followed in his footsteps, leaving a comfortable job in America to return to India. It was a tough decision, but I had faith in our nation, our systems, our foundational principles, and, above all, our Constitution.
Yet, today, as I see my father unjustly thrown into remand for a crime he never committed, my anger simmers, and my blood boils. Is there no limit to the depths political vendetta will sink? Why must a man of my father's caliber, who has accomplished so much for his country, state, and Telugu people, endure such injustice? Is it because he never stooped to engage in vendetta or destructive politics? Is it because he envisioned growth, welfare, and opportunities for our people long before others?
Today feels like a betrayal. But, my father is a fighter, and so am I. We will rise with an unstoppable force, guided by unwavering determination for Andhra Pradesh and Telugu people worldwide. I ask you to join me in this battle.
