Brandishing a firearm while being assaulted is perfectly legal in a vast majority of states, it’s only when you fire upon -keyword- “retreating” attackers that it’s illegal.

Anyone can obtain a DL provided they can pass the test and don’t have a criminal record that prevents them from having one. I see no issue.
