I would be livid if I was Elon. Imagine you go all-in, receive tons of death threats, your companies are under fire, but you keep your head on the mission to cut costs thinking you’re doing your part to save our country. You bring in the best and brightest young minds, convincing them even though they get death threats too. You make big progress, toiling every day, 16+ hour work days, never complaining. You convince yourself it’s worth it because you love the country and want a better future. Then, all your work is thrown out the window by some spending bill that increases the deficit and raises the debt ceiling by $5 trillion. And then you find out in 2 years they are going to need to raise the debt ceiling again because $5 trillion is going to be added to the federal debt over the next 2 years. Then the President says you’re “off the rails” and a “train wreck”. And you have to bite your tongue because how do you reply to that. You can’t make up this stuff.
Ripple is dropping our cross appeal, and the SEC is expected to drop their appeal, as they’ve previously said. We’re closing this chapter once and for all, and focusing on what’s most important – building the Internet of Value. Lock in.

But what does this mean for Ripple in relation to Judge Torres' August ruling?
First of all, the Torres ruling still stands.
While the SEC has agreed, in principle, to drop its appeal regarding the programmatic/secondary market sales, Ripple has not agreed to drop its own appeal challenging the $125M fine and the ongoing injunction that prevents it from selling $XRP to institutional investors without registering those sales as securities.
Sources close to the case suggest that the ball is now in Ripple's court, as it is technically considered a plaintiff rather than a defendant. Ripple has the option to continue appealing the fine and injunction, or to drop it.
Whether the SEC will engage in further negotiations surrounding the district court ruling remains to be seen. However, this is the aspect of the case we always knew would require a little more discussion and a little more nuance given the unprecedented circumstances both parties find themselves in amid this rapidly evolving regulatory landscape for digital assets.
However, as far as the SEC is concerned and after more than four years of battling it out in court, the agency is no longer actively pursuing charges against Ripple (pending commission approval of the appeal withdrawal, which is expected.)
This is it – the moment we’ve been waiting for. The SEC will drop its appeal – a resounding victory for Ripple, for crypto, every way you look at it.

🚨SCOOP: Two well-placed sources tell me that the @SECGov vs. @Ripple case is in the process of wrapping up and could be over soon.
My understanding is that the delay in reaching an agreement is due to Ripple's legal team negotiating more favorable terms regarding the August district court ruling, which imposed a $125M fine on the company and included a permanent injunction preventing the company from selling $XRP to institutional investors.
The argument, I’m told, is that if the new SEC leadership is wiping the enforcement slate clean for all previously-targeted crypto firms because it believes regulatory clarity will resolve the underlying issue, why should Ripple still be penalized? Accepting the Torres ruling as it stands would mean that Ripple is essentially agreeing to admit to wrongdoing — but now the SEC itself is seemingly unsure whether any wrongdoing occurred.
There’s no real playbook for this kind of thing which could explain why this case is taking longer to resolve than the rest. Stay tuned.
