Under international law, this territory is still governed by the terms of the League of Nations Mandate, written into the charter of the United Nations Article 80 and thus enshrined in the ratification of that charter by every UN member.

League of Nations Mandate Articles 2 and 4 define the eventual transfer of the trust authority (which was Britain) to the Jewish Agency and its successor, the State of Israel, as the sovereign with the sole purpose of establishing a Jewish national home.

Article 5 establishes that no territory can be removed from the areas designated in the Mandate for the establishment of this Jewish National home (as defined at San Remo) unless it is agreed to by the Jewish Agency (and its successor, Israel).

So no, there is no legality to establishing a Palestinian Arab state unless it is agreed to in a treaty with the State of Israel.
