When it comes to employer vaccine mandates, proper advanced notice of the policy is critical, for both unionized and non-union employees.

Discharge for non-compliance with covid vaccination requirement is unreasonable without a “real and demonstrated risk or business need” arbitrator holds, directing that policy be amended to provide for testing as an alternative

Searching my office bookshelf for something when I noticed my call to the bar memento engraved with "September 22, 2006". 15 years ago today!!! Thankful to be able to say time does go by fast when you're having fun.
Congratulations to @BrendanCHarvey for another successful wrongful dismissal case, with his client being awarded a 20 month notice period. Mr. Harvey and opposing counsel were both thanked for providing "thorough, well-presented, and helpful submissions": https://t.co/AanaiCvjUE
Among other issues, the Federal Court will be asked to consider the extent to which the Commission can advocate for the complainant's position through its mandate to represent the public interest before the Tribunal.
And here's the decision in this case - Smolik v. Seaspan Marine Corporation, 2021 CHRT 11 (CanLII) https://t.co/cxuB675E5e
...now on to defend the appeal.
Thanks to my colleagues at @YeagerLaw for their support with this case. It was a tragic and long road for our client - hopefully the decision will lead to better workplace accommodation practices, particularly for #employees with family status needs. #employmentlaw#humanrights
An interesting aspect of Seaspan's application for judicial review will be the claim that the interventions of the Canadian Human Rights Commission @CdnHumanRights "exceeded the bounds of appropriate behaviour by a participating administrative tribunal".
@DavidWa59907969@richardzussman Yes, but could it be the reason for lower testing numbers is in fact...fewer people needing/seeking tests (i.e. fewer people with symptoms, fewer people deemed close contacts, etc.)?
This is good, and makes me thankful for the many different advocacy opportunities provided by more senior colleagues earlier on in my career. @jonbenbak @UALawGrad @mguymurphy #advocacy#mentorship
Today, the Advocate received a letter from Chief Justice Hinkson encouraging more senior lawyers to involve more junior lawyers in trials and other proceedings to give them an opportunity to enhance their advocacy skills. We encourage you to read this letter and answer the call.
@YeagerLaw Thanks to my colleagues at @YeagerLaw and to the @CdnHumanRights@DroitPersonneCa for their support w/ this case. Was a tragic & long road for our client - hopefully decision will lead 2 better workplace accommodation practices, esp. for #employees with family status needs.

Just an outstanding result from @Jay_Spiro. We're all ecstatic for his client's win at the #CHRT! Look forward to seeing this decision posted in the coming days.
Um, hey #Bell...let's talk. What a tough day for all the fine folks at #TSN1040 - a big part of my work commutes for years. I'm sure severance will be paid but, what a way to terminate loyal and beloved employees - no notice, yanked off the air mid-show.
