The judge has rejected a bunch of OpenAI’s arguments for dismissing parts of various copyright lawsuits. His key decisions:
- OpenAI *can* be sued for conduct from >3 years before the lawsuits were filed, since they haven’t proved that the plaintiffs should have known about the infringement by then
- OpenAI may be liable for infringing activity of their users, since it’s reasonable to think they knew about it (it was widely publicized), and the existence of non-infringing uses doesn’t necessarily get OpenAI off the hook
Worth reading the whole thing, and final decisions won’t come until later, but it’s great news that the judge rejected these motions to dismiss.
