And that’s exactly why the United States was never designed as a pure democracy. Majority rule by itself is not the same thing as liberty. If every fundamental right had always been subject to a simple popular majority, imagine putting slavery itself up for a nationwide vote in 1860. Would 50% + 1 have abolished it? There’s no way to know, and that’s the point. The constitutional system deliberately places barriers between temporary majority sentiment and fundamental rights. Slavery ultimately required the 13th Amendment, which had to clear supermajorities in Congress and ratification by 3/4th of the states. Democracy matters, but so do constitutional limits, minority rights, checks and balances, and the rule of law.
