In Texas, you generally cannot be cited simply for offensive speech. The First Amendment protects speech that is offensive, unpopular, or insulting.

A citation may only be lawful if the speech involves:
• “Fighting words” likely to provoke an immediate breach of the peace
• True threats
• Harassment (repeated communications)
• Incitement to imminent unlawful action

Being offensive alone is not a crime.

- Overall over a 10 year period only about 2.5% or less was direct aid
- Founder Mark Breiner pocketed almost $5 million

Cancer Fund of America is even worse

- They raised tens of millions. One of several linked orgs totaling over $187 million across their entire network
- Professional solicitors took 80+ cents of every dollar
- Less than 1% went to actual patient aid in many years

These orgs were shut down after FTC and multi-state actions in 2015. It was one of the largest charity fraud cases at the time
