There is no current guidance in the Act on how procedures are affected by a change of property.
The new owner is bound by the previous owner’s decision depending mainly on whether or not work has commenced.

Section 11:11 of the #PartyWall Act can be interpreted as meaning that when a ‘building owner’ makes use of #works carried out previously by their neighbours, the ‘adjoining owner’ will have to pay a ‘due proportion of the expenses incurred'.
Is this #fair and #reasonable?

If you need #access onto another Owner’s #land or air space that is not granted under the #PartyWall Act, don't despair! We may be able to help you facilitate this, either by:
1) Negotiating an access license
2) Invoking the Access to Neighbouring Land Act 1992

Very questionable extension at a recent viewing of a duplex flat in Hammersmith - not sure what the previous owner was thinking! Always try to get access to the rear of a property, even if you're not viewing a ground floor flat.
In the event of a dispute, a neighbour may appoint their own surveyor to agree an award with the Building Owner’s surveyor.
Between them, the surveyors select a third surveyor to make a determination if they cannot settle the dispute themselves.

If you share a #PartyWall which forms the flank wall of your #RearAddition and your #neighbour plans on also making use of this wall (for an #extension), then they will have to pay you to make use of that section of wall.
Even if the wall in question is 100 years old!

The new PDRs mean many types of extension no longer need planning permission.
BUT - proposed works are still notifiable under the Party Wall Act!

A beautiful kitchen fitted in to a lovely extension in Highgate North London. You don’t have to spend thousands on a kitchen to get the look. This one was supplied by Howdens. Just needs to be fitted properly #build#loft#clients#quotes@WhichTraders@MumsTrusted@fmbuilders
Rosyln Road / Magri Williams Architects: The project comprises of a rear extension, loft conversion, and complete house refurbishment. In its basic form, the client’s brief was to enlarge the ground floor and provide an additional bedroom. https://t.co/L7C7XI6r4j
