May it be known though that EVEN IF GACHAGUA amended his Petition to remove the prayer for reinstatement, the consequences of Quashing the Impeachment by Rigathi Gachagua, should automatically make the occupation of the DP office as UNLAWFUL. Article 23 in fact allows the 3 Judge Bench to fashion that relief & further order that having found the Impeachment UNLAWFUL, the current occupant is UNCONSTITUTIONALLY in office. (1)

Secondly, if the court finds Gachagua to have been validly removed, any Appeal he lodges will automatically make imhim eligible to vie in 2027 if he wants. As long as an Appeal will be pending either at the CoA or Supreme Court by August 2027; the man will be eligible. ✅️
