Subject: Complaint regarding excessive and disproportionate music licensing charges imposed on small family functions held at reputed-star hotels
Respected Sir/Madam,
I am writing to bring to the attention of the Government of India a serious concern regarding the unusually high music licensing charges being demanded by music licensing companies/organisations for small private family functions conducted at five-star hotels.
In recent times, families organising events such as craddle ceremony, weddings, anniversaries, birthday celebrations and other private functions at hotels are being asked to obtain music licences and pay substantial licensing fees, even when the event is purely a private family gathering and is not organised for any commercial purpose.
The charges being demanded appear to be highly disproportionate when compared with the actual cost of engaging normal musicians/artists or entertainment services for such events. In several instances, the music licence fee alone is reportedly around five times the amount paid for the artists/entertainment themselves. This creates a significant and unreasonable financial burden on ordinary families who are organising one-time private functions.
I fully recognise the importance of protecting the rights of copyright owners, composers, music labels, performers and other rights holders. However, the licensing framework should also maintain a reasonable balance between protection of intellectual property and the legitimate interests of citizens conducting genuine private family functions.
A private family celebration at a hotel should not, in my view, be treated in the same manner as a commercial concert, nightclub, public entertainment programme or revenue-generating event. The scale, purpose, audience and commercial nature of the event should be taken into consideration while determining the applicable licence fee.
I therefore respectfully request the Government of India and the appropriate regulatory authorities to:
1. Examine the present tariff structure being applied by music licensing companies/organisations to private family functions.
2. Investigate whether the charges imposed on small private events are reasonable, proportionate and transparent.
3. Consider introducing a separate and substantially lower tariff category for genuine private family functions, including weddings, anniversaries, birthdays and similar celebrations.
4. Ensure that private citizens are not subjected to charges comparable to those applicable to commercial entertainment establishments.
5. Require licensing organisations to provide a clear and transparent calculation of the licence fee, including the legal basis, tariff category and repertoire covered.
6. Examine whether the current system results in excessive or disproportionate financial demands on consumers and small event organisers.
7. Consider establishing an appropriate grievance-redressal mechanism through which citizens can challenge unreasonable licensing demands.
8. Issue appropriate guidelines to hotels and licensing organisations so that families are not compelled to pay excessive charges without adequate explanation or justification.
I request the Government to kindly investigate this matter in the interest of fairness, transparency and consumer protection while, at the same time, ensuring that legitimate copyright and music rights are duly protected.
I would be grateful if the concerned authority could acknowledge this complaint and inform me of the appropriate authority or procedure for pursuing the matter further.
