There was never a treaty banning NATO enlargement. No document, no signature, no ratification.
Also, NATO didn't move towards Russia. Poland, Estonia, Latvia, Lithuania, Finland and others asked to join because they looked at Russia's behaviour and decided they'd rather not find out what comes after "special military operation"...
Turns out invading your neighbours is a fantastic NATO recruitment strategy.
