🚨 Roc Nation v. New York Marine Update:

New York Marine has officially moved to dismiss Roc Nation’s insurance coverage lawsuit and is directly pushing back on Roc Nation’s allegations that the company engaged in stonewalling, delay tactics, forum shopping, a bait and switch, and a broader “delay, deny and litigate” strategy.

The insurer argues Roc Nation is trying to sensationalize what it describes as a straightforward commercial coverage dispute. It says it never outright refused to defend Desiree Perez, but instead offered to defend her under a full reservation of rights, including allowing her to select independent counsel at the insurer’s reasonable expense, while reserving the right to later deny coverage or withdraw the defense.

NYM also argues Roc Nation cannot sue on behalf of Desiree Perez or Natalie Anderson because neither is actually a plaintiff and Roc Nation has not alleged that either assigned their individual insurance rights to the company. It is asking the Court to dismiss the breach of contract and declaratory judgment claims for failure to join necessary parties and to dismiss any claims Roc Nation is asserting on their behalf for lack of standing.

On the underlying coverage issue, NYM maintains that the remaining allegations against Desiree arise from an alleged personal family dispute involving her daughter and son in law, not from her duties as Roc Nation CEO or the conduct of Roc Nation’s business. It also points to policy exclusions involving intentional conduct and knowing violations of another person’s rights.

The insurer further argues that Roc Nation and Natalie Anderson are not entitled to reimbursement for their earlier defense costs because the lawsuit was not tendered to NYM until October 8, 2025, the same day both had already been dismissed from the federal case.

NYM is also attacking Roc Nation’s bad faith and deceptive business practices claims, arguing the bad faith claim merely duplicates the breach of contract claim and that Roc Nation has not identified actual facts showing a broader consumer facing scheme affecting other policyholders. It also wants the punitive damages request dismissed.

NYM also argues Roc Nation has identified no actual prejudice caused by the alleged delays, saying there was no default, lost settlement opportunity or adverse ruling. It defends its Florida declaratory action as a permissible way to resolve disputed coverage and says its reservation of rights expressly contemplated seeking that relief.

While NYM continues offering Desiree a defense under a reservation of rights, it says its investigation to date indicates the policies will not ultimately cover damages arising from the remaining claims because it views the alleged conduct as personal and unrelated to her duties as Roc Nation CEO. NYM also reserves the right to seek recoupment of defense costs if a court ultimately determines no coverage was owed.

NYM is asking the Court to dismiss Roc Nation’s complaint, including the bad faith and deceptive practices claims, or alternatively stay those claims until the underlying insurance coverage questions are resolved.
