When you're dealing with spin doctors like the Lively's you need something they can't spin to clear up the narrative. As Freedman says, people lie but documents don't. All settling this case would do is set the stage for them to use Easter Eggs to continue their defamation by implication and work to blacklist Wayfarer behind the scenes.
