SubTo (Subject-To):
You take over the deed… but the seller’s loan stays in place.
You’re stepping into their payment, their rate, their timeline.
Best for sellers in PAIN (behind, recently divorced, facing foreclosure).

Seller Finance:
The seller becomes the bank.
No existing loan (or lots of equity)… so you create brand new terms.
Best for sellers who want consistent INCOME, not a lump sum.

What changes between the two?

Negotiation
SubTo = inherit the terms
Seller Finance = create the terms

Paperwork
SubTo = authorization + servicing + protections
Seller Finance = note + deed of trust (you’re building a loan)

Risk
