Well, your Honor, let's look at this way. President Biden stated that his SCOTUS nominee would be a black woman. How would you feel if a middling white male Judge decided he was going to identify as a black woman and ends up getting the nomination? How does this Identity Politics scheme work when the Identity being championed is assumed with as little consequence as changing an outfit. While gender may be an expression of personality, sex is biological reality. Socially your freedoms allow you to pursue your version of happiness, with an important caveat. Your pursuit of happiness cannot, by its very nature, unfairly infringe upon another citizen's pursuit of their happiness. You want to live as a woman? By all means. You want to compete in an athletic competition? This is not about how your project your personality to society, this is about biological advantage. You must compete against your biological sex. Seems pretty simple.

The solution isn't a bureaucratic audit, it's holding jury trials to convict those guilty of malfeasance or failure to perform the duties of their office.
