@noamscheiber The problem is that this contract doesn’t necessarily rebut that proposition. We’ll see how the non-union employees do over the next three years, but Apple has both the incentive and the cash to make sure it’s at least slightly better than the unionized stores.
@MattBruenig@BrandonMagner@barnes_law You’re both correct but missing my point. Yes, this Board will adhere to MM as long as it can. But in the real world, whether agency decisions will hold up in the courts is quite relevant. Barring a 10(j)proceeding, I think Matt’s client may learn this lesson (in 2025 or 2026).
@BrandonMagner@MattBruenig@barnes_law Lastly, this may not be an issue in Matt’s case, but it’s worth noting that the NLRA only applies to non-supervisory employees, so that will be an issue in some instances.
@BrandonMagner@MattBruenig@barnes_law For example, most employers are careful to expressly carve out any cooperation with the NLRB and other government agencies from the confidentiality or non-disparagement provisions — this is unlikely to convince the current Board, but the courts may deem that sufficient.
@Sam_Vecenie In the last 9 seconds of that game: 1) an 80+% ft shooter missed the front end of a 1 and 1, 2) a 2-time national coach of the year failed to foul up 3, and 3) State’s player hit an off-balance bank shot 3 to tie. Crazy that they needed all that to get here.
@natalieweiner @thicc_flair It was a steal for sure, but it’s also true that the Beatles helped remind millions of people that real rock’n’roll (like Isley’s T&S) was so much better than the crooner drivel of other early 60s pop. And Lennon belted it like nobody’s business.
