I am pleased that Hon CJ @CJMarthaKoome has now established the Tribunals Appeals Division of the High Court at Milimani Law Courts following JSC's recommendations.
This is a significant step towards greater consistency, efficiency, certainty and access to justice.

It appears the HC decision on application of Sec 3 (5) of the LOSA has created some debate.
I will share other reasons why LOSA needs an overhaul.
Issue 1
Sec 14 (a) of the Matrimonial Property Act, 2013 provides that where matrimonial property is acquired during marriage and is registered in the name of one spouse, there shall be rebuttal presumption that the property is held in trust for the other spouse.
Section 3 of the LOSA defines “free property’ as ….property of which that person (deceased) was legally competent freely to dispose during his lifetime.
So is matrimonial property free property? Should courts determine matrimonial property shares in a probate matter?
I have consistently called for a comprehensive overhaul of the Law of Succession Act to align it with the current constitutional dispensation.
While Hon. @gpdkaluma's amendment to the Law of Succession Act, which defines a "spouse" by reference to the Marriage Act, was intended to address situations such as these, Section 3(5) of the Act was not repealed. It therefore remains part of the law and courts continue to interpreted the same as is.
