If you own land in upcountry,
And that land is:
- Outside a municipality
- Outside a town or urban area
- Classified as agricultural land
- And below 50 acres
When you sell it,
- You pay zero Capital Gains Tax.
Regardless of whether you sell it for 2 million. Or 20 million. Or even 100 million.
If the above conditions are met, the gain is exempt from CGT.
But, do not sell the land, keep quiet and assume KRA will know it qualifies.
You must apply for the exemption and support it with evidence.
So if KRA shows up, demanding its 15% share, do not panic. Show them the facts:
- The land is agricultural.
- It is less than 50 acres.
- It is outside the specified urban areas.
Do this and you will walk away with all your money intact.
Last year July, I met Jirongo. We sat at Cedars, Lenana Road.
I expressed my disappointment with the elusive Luhya unity and the constant competition amongst Luhya siblings.
I then met Governor Natembeya somewhere in Karen. At the time, he was enjoying national attention with his Tawe slogan.
He was with Caleb Hamisi. I told the Governor that I am volunteering to unite him with Eugene and Jirongo, and also see it that through Eugene and Jirongo's parties, a union of ideas can be born.
At the time, Malava by-election campaigns were ongoing, and Panyako was running on Jirongo's party.
I then met Jirongo the next day at Kiprono Kittony's Sirwo Coffee Restaurant in Lavington.
He agreed to meet the Governor and then Eugene Wamalwa to unite them, so that they don't fall out.
We agreed that I should spearhead talks with younger Luhya politicians like Malala, Hamisi and Sifuna, then, together with Eugene, we would meet Mzee Atwoli, who would take us to Oparanya, Wetangula, and Musalia.
He also tasked me with meeting Governor Fernandes, so he would agree to end the conflicts between him, Nabii Nabwera, and Oparanya.
Our goal was for these Luhya politicians to discard political differences and start speaking for the M'baluhya.
Our other goal was for the older generation of Luhya politicians like Musalia and Gumo to support and mentor the younger ones.
From Busia to Busali, from Likuyani to Nyang'ori, from Kitale to Luanda, every corner of Luhya land would be speaking with one voice.
After the meeting, he called Panyako to follow up on Malava's campaign.
All was well.
He then said he was travelling to Libya and would be back in October.
We parted ways amicably, and I travelled back to Western.
A few days later, I saw Panyako with Natembeya, and I thought Jirongo had chosen not to field a candidate.
CJ was later disappointed that Panyako abandoned the party even after being funded to run on it.
Then Malala and DCP also dropped from the race, and I thought Jirongo had talked to him, as this was our behind-the-scenes discussion.
Since CJ had left, I chose to focus on other things.
On October 15th at around 6 am, I saw CJ's call and knew he was setting up another meeting, only for him to break the news of Baba's death.
This therefore meant we would wait. He set up a meeting in January 2026 because after the Funeral, there would be so much happening like by-elections in Malava, and then Christmas holidays.
"Amerix, we don't have time. If we don't unite these politicians now that Baba has left us, we shall be scattered," he said.
Unfortunately, CJ lost his life, on 13th December.
It was so devastating. A sad loss.
Now, when I see Caleb, Natembeya, and Eugene bickering, I get so disappointed.
Caleb has his party. Natembeya has taken CJ's party. Eugene has his party.
Even the fact that Kalonzo has ring-fenced "Ukombozi" yet Natembeya had all the time to amend Jirongo's party makes me wonder if Luhya political leaders are strategic and intelligent.
Political success requires strategy, cunning, Machiavellianism, persuasion, give-and-take and ruthless pursuit of goals, not just slogans and rallies.
Luhya politicians appear clueless, disorganized and and jealous of each other.
No one wants to see the other reach the top political summit.
Please, Abaluhya politicians, put aside your egotistical differences and work for the M'baluhya.
You will never attract meaningful collaboration if your house is divided.
Luhyas are stranded.
It is embarrassing.
I want to restart the journey of talking to these politicians.
Change or Perish.
I understand he did what he did ndio mkatoka huko but usiMock the hand that fed you when you had nothing.. He once came through for you no matter the shortcomings that may have happened later.. Usijifanye mauru kwa uduu

Looks like Kenya Bankers Association (@KBA_Kenya) persuaded the National Assembly on the matter of imposition of VAT on the sale of reposessed/seized collateral when recovering bad debt.
The Association made this submission as a response to the Tax Appeals Tribunal's judgement on Appeal No.E023/2024 KCB Bank Kenya Limited vs Commissioner Legal Services & Board Co-ordination (see quoted tweet).
Finance Act 2026, signed into law by President William Ruto yesterday, now amends SecA of the 1st Schedule to include
"making of any advances or the granting of credit, including the sale, disposal or realisation of collateral, repossessed assets or secured property arising from the enforcement of security for loans"
Inclusion into the 1st Schedule of the VAT Act means that it is now exempt from VAT.
On Family Bank's early days, TK Muya was:
- the founder
- the CEO
- the executive chairman
- the HR manager
- the accountant
- the lending officer
and the first employee, all at once.
He could not afford to hire expensive professionals and had to save costs to make sure the bank survived.
His advice to every entrepreneur:
"You don't start a company and then employ a very expensive CEO. You start there and then you grow gradually. When you start, you start small. Pole ndio mwendo."

UPDATE: Kenya's shift to dual assessment tax regime
The National Assembly has passed two crucial provisions regarding pre-population of tax returns:
· The Revenue Authority will be obliged, in the event of an assessment borne out of pre-populated returns, to issue to the taxpayer written reasons informing the assessment source of the data captured within 30 days of the determination
· Taxpayers will be granted an opportunity to amend liabilities that are informed by pre-populated returns
Most people around you want you to fail,
They expect that when you fail,
• You will join them in their miserable lives,
Or,
• They will inherit your position so that they can succeed like you.
But if you don't meet their expectations of failure, they become even angrier and more hateful towards you for no reason,
Your growth and progress annoy them when you refuse to be the failure they expect.
Your discipline and determination to succeed angers them.
They will even become vengeful when you refuse to listen to their mockery and insults.
Such people cannot go far in life,
They will remain insufferable,
They will remain stagnant because their minds are full of mould as a result of jealousy, and their hearts are coated with thick black soot due to unnecessary hate towards a person who is just minding his business and has not done anything wrong towards them.
The only mistake you made is that you chose to pursue your purpose with discipline, order and consistency.
That is what irks them.
Refuse to accept their mockery and insults.
Focus.
In the end, you will win.
One of the most underrated foods in traditional African nutrition is OX TAIL SOUP.
We buy expensive, yet useless supplements, protein powders, collagen drinks, and laboratory-made products while ignoring foods our grandfathers ate regularly.
OX TAIL is rich in collagen, gelatin, amino acids, minerals, and healthy fats.
• The gelatin supports joint health.
• The collagen supports connective tissues, tendons, ligaments, skin, and blood vessels.
• The amino acids, especially glycine, support sleep, recovery, and tissue repair.
For men above 35, whose joints ache after exercise or whose backs hurt after long hours of work, or who are recovering from illness, ox tail soup is the preferred medicine for healing and recovery.
Ox tail soup is also good for Mothers who have just given birth and are just about to breastfeed colostrum to the newborn.
Babies who have just started weaning should be given Ox tail soup in plenty.
Our ageing parents don't need calcium supplements, they need nutrient-dense foods like the ox tail soup.
The strongest men in history did not build themselves on processed foods.
They built themselves on nutrient-dense traditional foods.
Sometimes the solution is not in a pharmacy, it is in our kitchen.
