I understand this is a preliminary hearing, where the standard is merely probable cause.

As a retired police officer, I have personally led homicide investigations and have handled more homicide cases on the criminal defense side than I can count.

For context, I have defended cases involving overwhelming direct and circumstantial evidence — for example, a suspect captured on clear surveillance video committing the homicide at a gas station, positively identified by a witness immediately prior to the shooting, apprehended shortly thereafter in the same clothing, still in possession of the murder weapon, and with ballistic analysis confirming a match to the fatal projectiles.

All I am seeking in discovery is sufficient evidence to establish that the prosecution has identified the correct perpetrator.

I am not asserting that Tyler Robinson had no involvement. However, based on the discovery provided to date, the evidence does not yet rise to a level that would convince me — or, more critically, a jury applying the beyond-a-reasonable-doubt standard at trial — that the State has charged the correct individual.

I would be satisfied with clear, admissible evidence such as: video footage depicting Tyler Robinson as the shooter (holding a firearm, taking the shot from the roof, in a sniper position), a clear photographic identification, his own post-Miranda admissions or confession, or credible, corroborated eyewitness testimony establishing him as the triggerman.

Law enforcement officers are human and can make mistakes in identification, evidence collection, or chain-of-custody procedures.

Until the discovery contains stronger, more compelling evidence capable of sustaining a conviction under the beyond-a-reasonable-doubt standard, I remain unconvinced.

5. The officer who responded to the Losee Center had his bodyworn camera stop working when he arrived at the roof.

6. The officer who responded to the Losee Center roof was accompanied by an unidentified man with a gun and badge from an unidentified agency.

7. Officers have no identifying information for the person on the Losee Center roof, including an inability to identify his height, face, or clothing.

8. Officers can only state the guy on the Losee Center roof was carrying a long item and cannot state that it is a gun.
