Now mind you, this may change, as AI companies get granular with interim controls allowing for human selection, organization, and arrangement in the middle of the GPT run. But for now, the fight against AI needs to be less about what is art and more about what is copyrightable.

1/2 Yup. :( The KEY to winning this fight is copyright. The immediate results of a GPT program, whether text or visual, currently are not protected under US Copyright w/out additionally human authorship is added in post, and then the protection is only for the human authorship.
