@OrthoGrievous @Hoppeism Law is natural and objective. The court, doesn’t make law, it evaluates the application of it. We reject the idea of positive law (that law is made by an authority) in favor of natural law. Which court to go to would be agreed upon by both parties.

@OrthoGrievous @Hoppeism There wouldn’t be a standard for security, it’d be up to the owner to evaluate the risk and decide what’s appropriate. If their property is damaged and the perpetrator can’t be found, they’d have to cover the costs. If there’s little to no risk, security measures are a waste.

@OrthoGrievous @Hoppeism It’s less likely to be the owner, but they might make a contract with insurers to take liability in exchange for endorsement of the roads. If a road is especially bad, an insurer could stipulate not to use it and not cover damage if you do, the owner would wanna prevent that.

@OrthoGrievous @Hoppeism That’d be a very situational thing. If the road isn’t built to the standard of the contract, then the contractor. Whether or not the insurer is held liable depends on the insurance contract of the individual drivers.
