My take on today's primary is that Hannah Pingree has a decent chance of beating Nirav Shah, that is, if she makes it to the final round. However, if she falls behind Troy Jackson in the penultimate round, Shah is in a much better spot in the final round.

📌เนื่องในวันครบรอบ 2 ปี ทุจริตเครื่องออกกำลังกายแพง (ลู่วิ่ง 750,000) ผมเลยขอประกาศ “ผลการสอบสวน” แบบชัดๆ ของคกก.สอบสวนวินัยร้ายแรง ที่ผู้ว่ากทม.แต่งตั้งขึ้น ได้ทำการสอบสวนจนท.รวม 32 ราย และตัดสินว่า

🔸จนท. 20ราย “ไม่มีความผิด”
🔸ส่วนอีก 12ราย “ผิดไม่ร้ายแรง” สั่งปรับ 2% ของเงินเดือน (หรือแค่ 600บาท/คน) แล้วปิดคดี‼️

เรื่องนี้ ผมคงยอมไม่ได้ เพราะทั้งที่ กทม.เสียหายเป็น ร้อยล้าน แต่คกก.ที่ผู้ว่าตั้งกลับสอบสวนแบบฟอกขาว โดยธงคือขอแค่มีคำว่า “ผิด” เอาไว้ตอบสื่อไวๆว่า “ลงโทษแล้วนะ”

แต่แท้จริงๆ บทลงโทษคือ “ปรับแค่ 600 บาท” และยังทำงานต่อในกทม.‼️

😡ซึ่งนี่ไม่ต่างอะไรกับการยืนยันว่า คดีนี้ “ไม่ได้โกง” แค่บังเอิญผิดพลาด จนซื้อของแพงกว่าราคาปกติ 5-10 เท่า และคนกรุงก็ต้องก้มหน้ารับสภาพ โดนปล้นเงินฟรีๆเป็นร้อยล้าน ทั้งที่เป็นคดีทุจริตที่ทุกคนเห็นคาตาว่า ”โกง“

ไม่ว่าจะ “ล็อคสเปกสินค้า” “ล็อคคุณสมบัติ” “ล็อคผลงาน” “ปั้นราคากลางแพงเกินจริง” “โกงสืบราคาพวกเดียวกัน” ตลอดขบวนการมีแต่การ ”โกง“

แต่ในสายตาของคกก.ที่ผู้ว่าแต่งตั้งมาสอบ การโกงตลอดขบวนการแบบชัดเจนขนาดนี้ กลับเป็นแค่เรื่องเล็กๆที่ “ผิดไม่ร้ายแรง”

📌เรื่องนี้ ผมเคยเตือนเมื่อปีที่แล้ว https://t.co/hxlVdagisK ว่าจะรอดหมด แต่กทม.ออกมาโต้ว่ายังสอบสวนอยู่ และสุดท้ายก็เกิดขึ้นจริง

นี่คงเป็นบทเรียนราคาแพงสำหรับผมที่หลงเชื่อกทม. และไม่คิดว่า กทม.จะกล้าตบหน้าคนกรุงเทพ เสมือนว่า ต่อให้รู้ว่าโกง แล้วจะทำไม

สำหรับผม การสอบสวนของคกก. เป็นการสอบที่น่าเกลียดที่สุด เพราะคดีอื่นอย่างพวก ยืมนาฬิกาเพื่อน, ซุกหุ้นศักดิ์สยาม, โกงเช่ารถขยะ EV, หรือ เขากระโกง คดีพวกนี้ยังมีความซับซ้อนในการทุจริตมากกว่าคดีเครื่องออกกำลังกายหลายเท่า

👉🏻การสอบของกทม. ไม่ใช่แค่เสมือนเป็นการ “ล้มคดี” แต่คือการดูถูกคนกรุงเทพฯ และเป็นการสร้างมาตรฐานให้หน่วยงานอื่นไปลอกเลียนแบบตาม ถ้าขนาดกทม.ที่สร้างภาพว่าสะอาด โปร่งใส ยังถือว่า การกระทำเหล่านี้ไม่ผิด ต่อไปก็จะมีหน่วยงานอื่นๆไปลอกวิธีการโกงของกทม.ไปใช้ทั่วประเทศ และประเทศจะเสียหายขนาดไหน?

👉🏻รายละเอียดการสอบสวน ผมสรุปง่ายๆคือ คกก.ที่ผู้ว่าแต่งตั้ง ใช้ดุลพินิจโดยแยกการสอบออกเป็น 2 เรื่อง คือเรื่องราคาของแพงหรือถูก และ เรื่องสเปกว่ากีดกันไม่กีดกัน

1. เรื่องราคา ทางคกก.ตรวจสอบ เครื่องออกกำลังกายที่ซื้อแพงหรือถูก โดยการส่งหนังสือไปถามยังบริษัทขายเครื่องออกกำลังกาย 7 บริษัท ให้ช่วยจัดทำใบเสนอราคาให้ โดยส่วนใหญ่กทม.ไปถามคือบริษัทฟิตเนส อาทิ Fitness First, We Fitness (ซึ่งไม่ได้ขายเครื่องออกกำลังกาย และเขาก็ไม่มีทางใช้ เครื่องยี่ห้อกับที่กทม.ล็อคสเปกจัดซื้อมาอยู่แล้ว เพราะคือ OEM ที่ไม่มีขายในท้องตลาด)

และที่หนักกว่าคือ แทนที่คกก.จะถามบริษัทที่ขายเครื่องออกกำลังกายเจ้าอื่นๆในตลาด รวมถึงเอกชนที่เคยทำเรื่องร้องเรียนต่อกทม.ว่า TOR ของกทม.ทุจริต ล็อคสเปก แต่คกก.ของกทม.(แกล้งโง่) ไปถาม คือบริษัทที่ชนะประมูลขายลู่วิ่งล็อคสเปคแพงๆ ให้กทม. (ทั้งที่บริษัทเหล่านี้ควรเข้าข่ายต้องสงสัยว่า สมรู้ร่วมคิดทุจริตเสนอราคา แต่กทม.กลับยังจะไปถามราคา) และก็เป็นไปตามคาด ทุกบริษัท ไม่มีบริษัทไหน เสนอราคากลับมาให้กทม.

เมื่อไม่มีบริษัทไหนตอบ คกก.สอบสวนของกทม.ก็เลยสร้างบทขึงขังปลอมๆขึ้นมา โดยไปลงพื้นที่แวะร้านขายลู่วิ่งซัก 2 ร้าน ให้พอเป็นพิธี ข้าไปถามเขาว่ามีเครื่องออกกำลังกายแบบในสเปกที่กทม.จัดซื้อไม่ ซึ่งพอทั้ง 2 ร้านไม่มีสเปกแบบที่กทม.จัดซื้อ คกก.ก็เลยสรุปว่า ในเมื่อไม่เจอลู่วิ่งแบบที่ตัวเองจัดซื้อ ก็ถือว่า ไม่อาจสรุปข้อเท็จจริงได้ว่า ราคาที่กทม.ซื้อนั้นแพงหรือถูก และก็เลยสรุปว่า งั้นถือว่า “ผิดไม่ร้ายแรง” ตัดเงินเดือนแค่ 2% คนละ 600บาท ละกัน

2. เรื่องการล็อคสเปก คกก.ไม่ได้ให้รายละเอียดการสอบมากนัก แค่สรุปว่า ตัวจนท.คกก.ที่จัดทำคุณลักษณะเฉพาะของพัสดุ (สเปก) และ ราคากลาง (TOR) ได้เขียน TOR กีดกัน แต่สำหรับคกก.ถือว่า “ผิดไม่ร้ายแรง” เลยปรับจนท.ที่เขียนเงินเดือนแค่ 2% แล้วยุติเรื่อง

‼️และที่ร้ายแรงที่สุดคือ ผู้ว่าชัชชาติ “รับทราบ” และ “เห็นชอบ” กับรายงานผลการสอบสวน โดยไม่ได้สั่งสอบใหม่แต่อย่างใด

ซึ่งไม่รู้ว่า ผู้ว่าอาจจะคิดว่า คกก.สอบสวนดีแล้วหรือไม่ ถึงเห็นชอบรายงาน แต่สำหรับผม คกก.ตกหล่นหลายเรื่องมาก และเป็นการฟอกชาวให้จนท.ทุจริตแบบสุดๆ
