Imagine two families living next door to each other on the same street in Evanston since the 1950s. Same schools, same taxes, same city services, same everything the law has ever cared about.

Today, the city is cutting one of those families a $25,000 check and telling the other family they don’t qualify. The only difference? One family is Black and the other isn’t.

That’s the government openly deciding who gets public money based on race.

The Constitution doesn’t allow this. The Equal Protection Clause doesn’t protect racial groups ... it protects persons. It was written specifically to stop the state from sorting citizens into different classes and treating them differently based on ancestry.

Once you accept that the government can hand out benefits or punishments according to race, you’ve accepted the exact principle the 14th Amendment was designed to kill.

Even if you set aside the constitutional problem, the logic still collapses under basic common sense.

Evanston didn’t identify specific victims of specific illegal acts and then narrowly tailor a fix to them. They just drew a racial line, declared everyone on one side of it eligible, and started writing checks.

Chief Justice Roberts put it plainly: the way to stop discriminating on the basis of race is to stop discriminating on the basis of race.

Evanston looked at that rule and decided to try the opposite approach instead. It doesn’t hold up under the Constitution, and it doesn’t hold up under basic fairness either.

Mahender Makhijani, 44, a lawful permanent resident from India living in Corona del Mar, was arrested this morning on a federal criminal complaint charging him with defrauding a bank out of nearly $100 million.

Makhijani controlled Cantor Group V LLC, a Newport Beach-based company that had a lending agreement requiring it to pledge only first-lien real estate loans to the victim bank.

Makhijani falsified title policies from September 2024 to April 2025 to make it appear Cantor held first-lien positions when other creditors were ahead. Makhijani and a subordinate forged documents in Adobe, altered metadata, and submitted the falsified records to the victim bank, while also providing misleading explanations during calls and in spreadsheets.

If convicted, Makhijani faces a statutory maximum sentence of 30 years in federal prison. He is expected to make his initial appearance this afternoon in U.S. District Court in Santa Ana, California. All defendants are presumed innocent until convicted in court.
