Dear FLs of Uganda, we are leaving in the era where law and politics collided. For the greater bar of tomorrow, I write this as your guide to avoid making irrational decisions.
Law and politics are not strangers they are siblings born of the same womb: The old question every serious jurist must wrestle with is whether law can tame politics or does politics in the end always have the final word over law?
A.V. Dicey gave us the liberal dream: the "Rule of Law" . a government of laws, not men. In his vision, law sits above politics; even the state must bow to it. This is the ideal every constitution recites.
Carl Schmitt shattered that dream. He argued the politics is superior to the law . A sovereign is he who decides on the exception." When crisis comes, it is not the law that decides; it is political power that decides whether law even applies. Politics to Schmitt always has the final say.
Max Weber added that law only holds because it rides on legitimate political authority. the state's monopoly on force.
Strip away political power and the law is just ink on paper. In other words Law does not float above politics, it is sustained by it.
Alexander Bickel gave the mechanism a name we now see too often: the political question doctrine. Courts, he said, are the "least dangerous branch in the seperation of power triangle" and wisely so, they must sometimes step back and let political actors settle political matters, rather than pretend every conflict has a legal answer.
Ran Hirschl later showed the reverse can also happen. the "judicialization of politics," where courts get pulled deep into political battles they were never built to referee. Uganda today lives exactly inside that tension. law and politics crushed into one another.
Dear our future lawyers more so the young lawyers in Uganda, know which era you stand in. This is not an era where law calmly supersedes politics as Dicey imagined. This is Schmitt's era where the political decides, and the law simply follows behind, bruised.
Some senior political lawyers will call you into cases against the state, dressed as noble legal battles. Use your reason. Ask yourself: is this really about law, or is it their relevance, their headline, their cheque? When the case fails, it is not their family that bears it, it is yours.
Before you accept such a case, understand the political question doctrine will likely and actually it will be invoked not as a scholarship, but as a shield for the state. Bail will not come easily. Courts will "decline jurisdiction." You will sit, and your family will suffer, alone, while the senior lawyer who recruited you moves to the next brief.
This is not cowardice, it is a strategy. There is a time to confront power and a time to out-wait it. A government in transition rarely hears confrontation, it hears patience dressed as principle. Ask for a reform politely. Let the request find the ear that is finally willing to listen.
Every era of "law crushed by politics" eventually normalizes. Why are you forgeting so first your constitutional history, the period between 1971-79 the era where the 1967 republican contitution was removed wholly by the then president iddi Amin Dada. Those that uprose were killed of course we love them as our heros how about their families. Who takes care of them? History does not stay bent forever. Preserve yourself. Preserve your family. The lawyer who survives with reason intact will be needed far more in the normalized Uganda than the one broken fighting a borrowed war today.
Uganda does not need more lawyers of the moment. Uganda needs the lawyers of the future that people once dreamt of patient, reasoned, unbought, unbroken. Be that lawyer. ⚖️🇺🇬
