The greatest tell that today's SCOTUS decision was the result of political cowardice and not history and fact is that the majority said the Citizenship Clause "must be understood in light of its historical context, from the English common law..."
(Pulling & paraphrasing excellent ideas from Edward Erler's book on this)
(1) The framers of the 14th Amendment would have been familiar with English common law and yet never once mentioned it during their debates. If the Framers intended for citizenship to be based on common law, why would they deliberately leave any reference to common law out of their debate? Had the framers intended citizenship to be based on common law, surely they'd have said as much (and probably saved time and energy)
(2) Under common law, people were *subjects* of the King. 'Twas the case until July 2, 1776. These subjects owed perpetual allegiance to the king. The Declaration and our Revolution transformed subjects into citizens where citizenship was based on CONSENT, not just the accident of birth. The Declaration renounced the King and with it, explicitly repudiated common law and subjectship.
(3) In throwing off the Crown, the Declaration turned subjects into citizens by making consent the basis of citizenship based on natural law and natural rights. Nobody has a right to rule another, and people must consent to being ruled.
Subject and citizens are NOT convertible terms, yet SCOTUS treats it as such by tying our 14th Amendment to Common Law. Irresponsible at best.
(4) Sen. Howard, during debates on this clause, specifically referenced "virtue of natural law." Reference to "natural law" would've been understood by the Senate as a reference to the Declaration of Independence and the social compact theory (ie: CONSENT of the governed). The framers of the 14th amendment were finishing the work of the Founding Generation, whose political theory literally rests on the idea of the social compact. The social compact theory stipulates that people CONSENT to form a political community. Membership into that political community flows from mutual agreement: ie: the existing political community must consent to you being here.
If someone enters the country illegally, by definitely they have not been admitted into the social compact and we did not agree to extend membership to them.
To assume, then, that their children are somehow entitled to automatic citizenship and membership into our social compact makes a mockery of the very idea of a social compact.
Today's SCOTUS decision on birthright is a direct repudiation of the social compact theory -- aka the entire basis of our political community.
How exactly can Congress allow somebody to take an oath to defend the Constitution of the United States if they openly advocate for eradicating the country?
