Today I filed a lawsuit against the state of Arizona, here is why.
Arizona's mail voting system is not a partisan invention.Ā It was created by RepublicansĀ in 1991, and for 35 years, voters of every political stripe have relied on it. Today, roughly 80 percent of Arizonans vote by mail, including seniors who are no longer driving, rural voters hours from the nearest polling place, people with disabilities, naturalized citizens, and working families who cannot afford to lose a day's wages standing in line. This system works, which is why I am a proud supporter of Protect the Vote Arizonaās efforts to enshrine our fundamental right to vote in the stateās constitution.Ā There is no crisis here.
But HCR 2001 threatens to unravel all of that. Its voter ID provision demands that every mail voter present "valid government-issued proof of identity" concurrent with casting a ballot, yet provides no mechanism,Ā no process, and noĀ procedure for how a mail voter could possibly comply. That vagueness is not an oversight. It is a blueprint for chaos, one that hands future legislatures the power to define compliance however they choose, under the deliberately lowered "rational basis" constitutional standard that this same measure would write into Arizona's Constitution. Once that provision is in place, courts would be stripped of the authority to strike down even the most restrictive interpretation.
That brings me to the most sobering part of this. I am not sure what is moreĀ dangerous,Ā the unintended consequences of HCR 2001, or the very real intended ones. Because when you remove the constitutional guardrails that protect voting rights,Ā when you hand future legislators a vague mandate and a weakened judiciary, and when youĀ package all of it in a measure that voters cannot even untangle and vote on separately, you are not building a more secure election system. You are manufacturing doubt. You are engineering confusion. And you are doing it on the backs of the veryĀ voters, think seniors, rural communities, people with disabilities, naturalized citizens,Ā who have the least power to fight back. Not today, not without a fight.
Arizona's elections are free, fair, and accurate. HCR 2001 is not about fixing what is broken. It is about breaking what works with the most nefarious of intentions.
