Subject: Formal Complaint Against “Cava Lounge, Malad (West)” for Hurting Religious Sentiments, Allowing Minors, and Permitting Drug and Hookah Consumption

Respected Sir,

I am writing this complaint to bring to your urgent attention a matter of grave public concern and moral misconduct taking place at Cava Lounge, Linkway Estate, New Link Road, Malad (West), Mumbai.

The said establishment is openly violating multiple laws and social ethics by engaging in the following activities:

1. Hurting Hindu Religious Sentiments

On the night of [mention date if known], the lounge was found playing and remixing the devotional song “Bharat Ka Baccha Jai Shree Ram Bolenga” in a highly inappropriate, disrespectful, and party-like environment involving alcohol, dance, and hookah.
This act has deeply hurt the religious sentiments of Hindu devotees, as such sacred chants are being used for commercial entertainment and mockery.

Such acts fall under:

Section 295A of IPC: Deliberate and malicious acts intended to outrage religious feelings.

Section 298 of IPC: Uttering words or acts with deliberate intent to wound religious feelings.

2. Allowing Entry of Minor Girls and Serving Hookah

The lounge is also allowing minor girls to enter and consume hookah and intoxicants, which is a clear violation of:

COTPA Act, 2003 (Prohibition of Smoking in Public Places and Tobacco Products to Minors).

Juvenile Justice Act, 2015 (Section 77 & 78): Supplying intoxicants to minors.

This reflects negligence and irresponsibility on the part of the management and staff, who are encouraging minors to participate in adult and illegal activities.

3. Open Consumption of Drugs and Narcotic Substances

It has been observed that illegal narcotic substances such as MDMA and other drugs are being consumed openly inside the lounge premises by certain visitors, with full knowledge of the staff and management.
This is a direct violation of:

The Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985.

Such activities pose a serious threat to youth and public safety, and it appears that the establishment is functioning with complete disregard for the law.

4. Demand for Immediate Action

In view of the above facts, I request your kind office to:

1. Conduct an immediate inspection/raid of Cava Lounge, Malad (West).

2. Suspend the licence of the lounge pending inquiry.

3. Register an FIR against the owner, manager, and staff responsible for the violations under IPC, COTPA, and NDPS Acts.

4. Inform the Social Service Branch and Anti-Narcotics Cell to assist in investigation.

5. Ensure that no minor is allowed entry in any such premises in the future.

These illegal and immoral activities are damaging the social and cultural fabric of the community and are setting a dangerous example for the youth. I request that strict legal action be taken to ensure that the law is applied equally, irrespective of influence or connections.
