@asymmetricinfo I'm a land use lawyer. I doubt NFIB v. Sebelius would be a problem so long as the bill was properly structured. Having the state government required to have certain laws in place in order to get funds for something related to the funding is fine.

@RealSpikeCohen What is missing here is that Chevron was a reaction to activist liberal judges trying to stop a conservative president from implementing his policies. The Court, rightly IMHO, decided to rein in the judges by telling the courts not to second guess agencies.
