This is a HUGE victory for Arizona parents, students, and school choice.

The union-backed Protect Education Act will NOT appear on the November ballot after failing to collect enough valid signatures required under Arizona law.

They spent millions. They submitted roughly 416,000 raw signatures. And when the trial court’s rulings put their campaign in jeopardy, the union-backed Protect Education campaign appealed to the Arizona Supreme Court.

They still lost.

The committee’s case depended on persuading the Arizona Supreme Court that duplicate signatures should still be counted toward its total. The Court rejected that argument, affirming the trial court’s method for removing duplicates and leaving the committee without the additional signatures it needed to qualify for the ballot.

After the county validity rates were applied, Protect Education simply did not have the 255,949 valid signatures required to qualify.

This victory did not happen by accident.

The Goldwater Institute led the legal challenge, while the Arizona Free Enterprise Club worked alongside Goldwater, school choice advocates, and parents across Arizona who refused to sit quietly while the unions tried to dismantle educational freedom.

They called their campaign “Protect Education.”

Arizona parents saw it for what it was...and fought back.

Today, school choice won.
Today, parents won.
And today, the effort to gut Arizona’s ESA program is OFF THE BALLOT.

Arizona families...not teachers unions and political special interests...should decide what education is best for their children.
