It has just occurred to me that part of what makes this anti-black racism from South African blacks so sexy for its white supremacist sponsors is that now ICE and Farage can say that hostility to immigrants knows no race.

But it does. No Boers are being thrown out of South Africa, no Norwegians are being told to get out of Britain and the US. All the immigrants being targeted with violence are black and brown poor people. That's why South Africans in the report dont see the irony of talking to a black foreign journalist. They didn't ask why Sky News failed to employ a black South African journalist.

Some years ago, the wife of a Kenyan governor made donations of underwear to boys in a primary school, not even 10 years old. The poor kids were made to hold the colored rags above their head for a group photo with her. The photo was in the mainstream newspapers.

Not a single "boy child" advocate said a word about this humiliation.

The Asymmetry of Rights: There in no Equality Before the Law for the IMF
1. Section 5 of the Bretton Woods Agreements Act of 1963, as read with the Schedule to the Act, creates an impermissible asymmetry before the law. Fund Agreement Article IX, Section 2 gives the IMF full juridical personality, including the capacity “to contract,” “to acquire and dispose of immovable and movable property,” and “to institute legal proceedings.”

2. However, Article IX, Section 3 then provides that the Fund, its property and assets enjoy “immunity from every form of judicial process,” except where the Fund expressly waives immunity.

3. The result is a one-sided legal relationship:
-The IMF can sue Kenyans in Kenyan courts.
-Kenyans cannot sue the IMF.
-The IMF can contract, own property, and enforce rights in Kenya.
-Kenyans cannot enforce rights against the IMF.

4. This asymmetry offends the constitutional principle of equality before the law. Article 27(1) provides that “Every person is equal before the law and has the right to equal protection and equal benefit of the law.”

5. Equality before the law is not satisfied where one legal person may invoke the protection of Kenyan law but is placed, by ordinary legislation, beyond the reach of constitutional scrutiny.

6. A statutory regime that allows an international institution to sue, contract, own property, and enforce rights in Kenya, while denying affected persons and constitutional organs effective access to judicial process, creates a one-sided legal relationship that cannot be justified under the Constitution.

The question is not whether Kenya may belong to the IMF or the World Bank. The question is whether the Bretton Woods Agreements Act, a statute enacted at independence in 1963 may continue, after the promulgation of the Constitution of Kenya, 2010, to authorise treaty implementation, borrowing, public expenditure, tax exemptions, and institutional immunities in a manner that weakens judicial control of public power, limits access to justice and information, and displaces the constitutional architecture of accountable public finance.

While the Act may have served a lawful purpose at the time of its enactment in 1963, its continued operation must now be assessed against the normative framework of the Constitution of Kenya, 2010.

To the extent that its purpose or effect is inconsistent with the Constitution, the provisions must be read down, adapted, or declared invalid.

Accordingly, even if the Act was constitutionally unobjectionable at independence, its continued effect in the post 2010 constitutional order cannot be sustained where it undermines or derogates from constitutional requirements.

This is completely ludicrous and stupid. The government is not the only agent of development. SACCO members build businesses, do construction, pay for health, education and other projects that generate wealth. The government will not "develop" anything except dead building like affordable housing and next years elections.

Kenyans, we must refuse this. The government might still go ahead, but we must not give this logic any oxygen. We must not accept that the role of the government is to develop the country. No. Development is done by ALL OF US through our brains and muscles. It's the work that we do that develops Kenya.

In 1290 all Jews were driven out of England. In 1306 they were expelled from France. In 1430 exiled from Germany, followed by Spain and Portugal. Boycotted in Italy, and time after time tossed out of every major European city.

After the centuries of expulsions, in 1492, Muslims (The Ottoman Empire) opened their doors for the Jewish. in the late 17th and 18th centuries, as the Ottoman Empire became less stable, Jews were finally allowed back into England after 366 years of total banishment.

After 1848, hundreds of thousands of Jews left Central Europe to escape rising nationalism and "pogroms" (anti-Jewish riots).

After WWI, Britain took control of Palestine from the Ottomans. From 1917 to 1939, Muslims (Palestine) opened their doors for the Jewish as usual.

This story is horrifying. Yani @ntsa_kenya officials can openly admit that they and e-citizen are both stealing from us, and they even pay for a bot farm to gaslight us with #Ntsafinesfacts.

Do these people know how humiliating it is to be surveilled and fined instantly with no space for redress? This is like the colonial hut tax. We're being fined not for breaking laws, but for merely existing. It's like all Kenyans have broken the law, so we're going to be fined for one of them.

This audacity is too much. We'll have to burn down the whole system at some point.
