HMRC have tried to use s684(7A)(b) with retrospective effect but the UT said that the provision plainly has prospective effect only.
This part of the decision will be a major blow for HMRC.

The membership of the #FinanceBill Public Bill Committee has been announced. This is for the Finance Bill Committee Stage. This will include scrutinising the Government’s amendments to the #LoanCharge following the Morse Review.

Parliamentary motion passed on 19 March 2020 to make the Loan Charge effective from 2017 ONLY but HMRC now sending out new settlement letters on the basis of 9 December 2010 while the EXISTING law still says from 6 April 1999!

Today I have written to @sajidjavid urging him to immediately publish the independent review into the Loan Charge and to suspend the payment deadline of 31 January. I will continue fighting this retrospective and unjust tax on behalf of my constituents.

Question for @HMRCgovuk, many umbrella comps offer 90% take home, why aren't you investigating them? Is it because they are doing nothing illegal and so you target the contractor for 'tax avoidance' ( which is also legal btw). How is this fair? #LoanCharge@sajidjavid

HMRC extend Settlement deadline to 31 August 2019 where dialogue had commenced before the Loan Charge date . . . . still a huge back-log of casework to be dealt with but 500 extra staff apparently allocated to Counter Avoidance.
