For reasons that are too obvious to some of us, CJ @CJMarthaKoome and the JSC are rushing crucial appointments in the judiciary ie the appointment of the Registrar of the judiciary, 20 plus judges of the High Court and 10 judges of the Court of Appeal in the next 30 days and well before LSK male representative Mr @omwanza is sworn on 14th May 2024. Although Mr. Macharia Njeru has few more days as LSK male representative, both CJ KOOME and the JSC must know, that Macharia has no mandate and legitimacy to participate in these critical recruitment as he is on his way out. The members of @LawSocietyofKe on 29th February elected their new representative. It is a universal norm in constitutional democracies that office holders whose terms are about to expire refrain from certain actions, activities, and appointments and give deference to the incoming office holder or administration. Remember in 2016 when the American Senate Majority leader Mitch McConnell refused to Process the nomination of Merrick Garland as a nominee to the Supreme Court of America on the basis that President Obama's term was ending and such a crucial appointment should await the new administration. The same applies here. CJ KOOME should not rush these important appointments and must wait for the LSK representative to be sworn in so that he can press his mandate and convey the views of his members to the JSC. I repeat, Macharia Njeru, with less than 4 weeks to go, has no mandate or legitimacy to participate in the recruitment of judges with constitutional tenure.
