The 28th Amendment tried to cut the provincial NFC share from 57.5% to 47.5%. It could not be passed through Parliament. The NEC has cut it to 35.2% anyway — and no one had to vote.

Here's how.

Three instruments, no amendment needed:

The Petroleum Levy (Rs1.677tn) sits outside the divisible pool — despite being, in substance, a sales tax that belongs in it.

The National Fiscal Pact forces provinces to generate Rs1.794tn in surpluses they cannot spend.

And a Rs960bn "grant," extracted after three postponed NEC meetings, transfers further resources to the Centre — an arrangement the Finance Minister confirmed extends beyond one year.

Article 160(3A) remains untouched. The 18th Amendment is formally intact. But the provincial share has been cut from 57.5% to 35.2% — significantly more than what the failed 28th Amendment proposed — bypassing Parliament entirely.

What the Parliament could not do, the NEC delivered more. No votes required.

Education and health are provincial subjects. Pakistan already spends just 0.8% of GDP on each — one-fifth of the government's own 4% commitment for education alone. The provinces constitutionally responsible for fixing that have just been left with a third of the money to do it.
