A registered sale deed isn’t always non-arbitrable- if it’s part of a private business arrangement with no third-party rights, arbitration can decide. Context matters for ascertaining arbitrability.

The challenge, then, is not whether to disclose, but how much to disclose and under what safeguards. Drawing on recent reforms, I argue for a middle ground: selective but meaningful disclosure. The goal should be to protect arbitral integrity without eroding confidentiality.

@BJVerbeek This is interesting. How do disclosure obligations in such cases work? As per normal disclosure obligations, the arbitrator is obliged to disclose potential conflict of interests. There are none here. And it's surprising that Italy did not know about this before.
