AJK’s 12 Seats: A Question of Legitimacy, Not Existence
The debate on the 12 seats in Azad Jammu & Kashmir has been framed as a simple choice: keep them or remove them.
That is the wrong question.
The real issue is how power, representation, and legitimacy are aligned within the system:
These seats were created for a clear purpose, to represent displaced Kashmiris and sustain the wider Kashmir question beyond geography. They reflect a historical reality rooted in displacement, identity, and an unresolved political dispute.
That purpose remains valid. But over time, their role has expanded beyond representation. Today, these seats participate fully in legislative processes, shaping laws, budgets, and crucially, government formation.
This creates a structural tension. Representation linked to the broader Kashmir cause operates on one logic: identity, continuity, and international signalling.
Governance within AJK operates on another: accountability to those who live, work, and are directly affected by decisions.
When these two roles sit in the same space, the system is asked to do two fundamentally different things at once.
This leads to predictable outcomes:
Blurred lines of accountability
questions over where authority ultimately lies and growing sensitivity around how decisions are shaped
Even where systems function, perception begins to matter, and perception shapes trust. That is the core risk.
The debate, therefore, is not about removing representation. Nor is it about defending the status quo. It is about alignment.
The question is how to preserve the indispensable role of these seats. while ensuring that governance authority rests where accountability lies. Because the principle is simple:
Who governs AJK must be determined by those who live under that governance.
Leadership, policy, and resource allocation must remain anchored in those directly affected by them.
At the same time, the 12 seats can, and should, continue to play their full role: Gving voice to displaced communities shaping the broader Kashmir narrative engaging the diaspora and reinforcing the political reality of Kashmir in the international domain
Handled correctly, this is not a diminution of representation. It is an elevation of it.
Many mature systems draw similar distinctions: preserving voice and participation, while calibrating how final decisions are made to ensure legitimacy and stability.
The underlying insight is straightforward:
Representation strengthens a system when it reinforces legitimacy. It weakens it when it becomes entangled in questions of governance authority.
The 12 seats should project the Kashmir cause outward,
not determine political power inward.
That is how both the principle and the system are protected.
