A DIFFICULT CONVERSATION⚠️
The enactment of CAB3 and the changes to Section 212 represent a critical juncture for Zimbabwe's democracy. Tolerating a narrative of parallel power from the military would directly undermine the very purpose of these reforms and pose an existential threat to the country's democratic progress.
🔍 Understanding the Context: CAB3 and Section 212
The now-signed Constitution of Zimbabwe Amendment (No. 3) Bill, commonly known as CAB3, has been a source of intense national debate. A central point of contention was Clause 20, which amended Section 212 of the Constitution, defining the function of the Defence Forces.
The final, compromise version of Section 212 now states that the function of the defence forces is to protect Zimbabwe and "to uphold the Constitution" but is explicitly made "Subject to Sections 207 and 208". This compromise was a direct response to fierce opposition, which argued that the initial proposal to change the military's mandate from "uphold" to "in accordance with" the constitution would strip the military of its independent guardianship role and turn it into an "instrument of executive will".
⚖️ Why a Parallel Power Narrative is Dangerous
Given this sensitive context, allowing a narrative of a "parallel power structure" to take root is dangerous for several reasons:
· It Undermines Civilian Authority: A core tenet of democracy is the subordination of the military to elected civilian leadership. A narrative suggesting the military or ex-service personnel hold a separate, co-equal power challenges this principle and implies their decisions can override constitutional processes and the will of the people.
· It Threatens the Rule of Law: This narrative suggests that power resides outside the constitution, enabling extra-legal interventions. The intense debate over Section 212 was precisely about preventing such ambiguity. Normalizing it would render the constitutional exercise meaningless.
· It Discredits the 2017 Military Intervention: The debate was framed as "coup-proofing" following the 2017 military intervention that brought President Mnangagwa to power. Critics argue CAB3 aims to prevent a repeat of such military action by clearly defining the military's role. Normalising a parallel power narrative would signal that the very event the amendment seeks to prevent is still a legitimate possibility.
· It Fuels Political Instability: As seen with groups like the "Guardians of Zimbabwe" a political party launched by retired security personnel former soldiers are becoming politically active. While political participation is their right, a narrative that casts them as a parallel power rather than citizens with a voice can deepen factionalism and create a volatile "state within a state".
For Zimbabwe's democracy to mature, the military's role must be unequivocally professional and subordinate to the constitution. The changes to Section 212 were a hard-fought effort to enshrine this principle.
Allowing a narrative of parallel power to persist would legitimize the very extra-constitutional actions these legal changes were designed to prevent. It would weaken civilian rule, threaten the rule of law, and create an environment of instability, undermining the progress Zimbabwe has made. For its democracy to grow, the nation must therefore consistently and unequivocally reject any such narrative.
