**Subject: Request to Abolish the Wakf Act Due to Its Unconstitutionality**

**Respected Chairperson,**

I,_______ a concerned citizen of India, write to you today to bring to your esteemed committee's attention the critical issue concerning the Wakf Act. It is my earnest belief that the current Wakf Act is unconstitutional and, therefore, warrants a thorough re-evaluation and subsequent abolition.

The Constitution of India under Article 14 enshrines the principle of equality before the law and prohibits discrimination on the grounds of religion, race, caste, sex, or place of birth.

However, the Wakf Act, in its current form, appears to provide preferential treatment to a particular religious community in the administration of properties and affairs, which arguably contradicts the secular fabric of our nation and violates the fundamental rights of 85% people of the country.

This special treatment is not extended to other communities and people of all other religions like under similar laws, creating a disparity that challenges the constitutional mandate of equality and fairness.

Furthermore, the Wakf Act's provisions often lead to issues related to property rights, administrative inefficiencies, and potential misuse of the law. There have been numerous instances where properties have been declared as wakf without due process or adequate compensation, infringing upon the fundamental rights of property owners. Such actions are in direct conflict with the right to property as envisaged under Article 300A of the Constitution of India.

It is also pertinent to note that the Wakf Act lacks adequate checks and balances to prevent misuse of power by Wakf boards, resulting in allegations of corruption, mismanagement, and lack of accountability. This not only undermines the rule of law but also erodes public trust in the legal and governance framework of the country.

The current Waqf act is illegal and such act does not exist anywhere in the world including Muslim majority countries. Also, Waqf act allowed waqf board to snatch land & property through coercion, deceit and violence, like mafioso.

In light of the above, I urge the Joint Parliamentary Committee to consider the following recommendations:

1. **Abolition of the Wakf Act**: The Act should be repealed to ensure that all citizens are treated equally before the law, in consonance with the fundamental principles enshrined in the Constitution.

2. Waqf act should be abolished forthwith and retrospective from the date it was first introduced in 1923 as Mussalman Waqf Act and subsequent reintroduction in 1954 and ammendment in 1995.

3. any land/property acquired or structure erected under Waqf should be deemed illegal and returned to the rightful Hindu owner before or after 1923.

4. In case, rightful Hindu owner cannot be traced, the Central Govt should take the possession of the land, property and structure, under current Waqf boards.

4. Strengthening Accountability : Any new legislation should incorporate strict guidelines and accountability mechanisms to prevent misuse and ensure transparency in the administration of properties.
