✨ TERMS OF SERVICE AGREEMENT TEMPLATES AND BREAKDOWN FOR ARTISTS AND CLIENTS ✨
there is a discussion going on about personal vs commercial use as well as a lot of people who are confused and misinformed about who owns commission artwork.
this is an extensive legal style terms of service agreement template that artists and clients should reference because a lot of these terms are standard in your agreements already but are not clarified properly. this template should clarify things.
COPYRIGHTS / RIGHTS OF USAGE / INTELLECTUAL PROPERTY: as a reminder, copyright is over the work done by the original creator, it does not get transferred unless you have specific legal agreement to do so. clients only purchase certain rights of usage. there is also intellectual property rights of a character design / brand / identity. these are all three different things that are involved in commission art agreements.
I will need to circulate this again as I have in the past, and if you read this in depth, it should be still easy to understand but very clear breaking down everything
from rights and usage, timeline protections for clients, payments and refunds and cancellations, and guarantees that work is original and reference material is not stolen.
all of these terms are very important and should be incorporated in TOS. this TOS is of course very lengthy, so if you wish for something more concise please cover the points still. that said in any agreement between artists and client it is a work contract and should hold legal weight.
I am not a lawyer and the agreement is not going to be perfect, but I have conferred with some who have experience with contracts as well as coming from a background of design business, but the hope is that you will have a much better foundation to work off of, even if it is not perfectly written.
