As I said last week, the prosecutor’s “mortal sin” question was a blatant violation of Mass. G. Evid. § 610. Now a Commonwealth’s expert has again injected Clancy’s Catholicism into the case.

The Commonwealth appears to be substituting religious condemnation for Massachusetts’ legal standard of criminal responsibility. This is not merely improper—it is outrageous.

The repeated violations now raise a serious Oregon v. Kennedy question: whether the conduct meets SCOTUS’s narrow “goading” standard—prosecutorial conduct intended to provoke a mistrial.

At a minimum, the ADA’s conduct warrants sanctions.
