A #NEWTOWN man has been banned from keeping dogs for eight years and his XL bully must be put down after he was seen being walked un-muzzled near a children's play park.
Carlos Fraser, of Heol Y Coleg in Newtown, appeared for sentence at #Wrexham Magistrates Court on Tuesday afternoon.
The 30-year-old had previously admitted possessing or having custody of a fighting dog, and allowing a fighting dog to be in public without a muzzle/lead.
Prosecutor Rhian Jackson told the court both charges related to the defendant's XL Bully dog, named Bronson.
On April 20 at about 5pm, a male who wasn't Fraser was seen by police walking Bronson without a muzzle near a children's play park in Newtown.
He was told to put the muzzle, which he had in hand and said he was going to apply when he reached town, on the dog.
He claimed the dog was "the biggest softie going", but complied and walked off towards the town centre.
Ms Jackson told the court Fraser had never had formal permission to house a dog at his home by his housing provider.
Officers who visited his flat found what appeared to be excrement all over the floor, and refused to enter because of the smell.
A maintenance operative who went to the property to carry out work on the boiler came away reporting the property was "swimming in dog s***".
Ms Jackson told the court Bronson was subsequently seized and has been housed in kennels since May last year, at a cost of more than £8,000.
It was also said that he did not realise how many responsibilities would come with Bronson, but that after he housed the dog, he 'bonded' with him.
He sought help from a charity to cover vet's bills, the court heard, but would struggle to pay the kennelling costs outlined by the prosecution.
The court heard while the defendant had previously struggled to accept Bronson may be destroyed as a result of the offences, by the time of the sentencing hearing he had come to terms with it.
District Judge Gwyn Jones was asked to bear in mind that the dog had not shown any aggression in the course of the offences.
He told the defendant he had reached the conclusion he was "no longer a fit and proper person" to have a dog, and banned him from owning one for eight years.
The District Judge also imposed an immediate destruction order for Bronson.
Fraser received a 12-month community order with 180 hours of unpaid work.
He must pay a £400 contribution to prosecution costs, £400 contribution to kennelling costs and a £114 victim surcharge.
Another irresponsible owner causes a dog that has not shown any aggression to be killed by the authorities. What will it take for @UKLabour to see that new laws around breeding and ownership need to be put in place to keep pets and the public safe?

Bronson has done absolutely nothing wrong and will be euthanised any day now. Just because his owner failed to comply with the law.
Someone who has a previous relationship with Bronson who would be willing to take him in can challenge this in court. It could be that they walked the dog, looked after the dog while owner on holiday etc. It doesn't have to be for long.
Support from expert groups will be available and rescuers can fundraise for court costs.

RECEIVES 12 months in prison‼️‼️
Lukeman, who is originally from #Penge, South-East #London and has links to Grays in Essex, pleaded guilty to six animal welfare offences in total in relation to a dog called Mulla, later renamed Hope. He admitted inflicting physical abuse resulting in injury, failing to provide veterinary treatment for the dog’s injuries and two counts of failing to protect her from injury, pain and suffering.
Mulla was taken to the vets by a lettings agent on January 9, 2024, after she found her locked away in a bathroom of Lukeman’s flat.
She had fresh cuts on her head and what looked like blood dripping from her mouth.
Her teats were hanging down, her tail was bent, she was very thin with her ribs visible and her eyes were gunky and red.
When examined by a vet she was found to have a number of injuries consistent with blunt force trauma.
Evidence also showed she had a severely swollen face, especially on the right side with blood stained saliva dripping from her mouth.
Mulla was taken to the RSPCA Finsbury Park Animal Hospital for further treatment.
Here, x-rays revealed she had several fractured teeth, a fractured skull and fracture of both cheek bones.
The skull and cheek bone fractures were found to be recent injuries.
As well as the recent injuries found around her face and head, a number of other skeletal injuries were noted including fractured ribs and dislocated tail vertebrae.
Despite numerous treatments, her injured eye could not be saved and it was removed at a later date.
Speaking after the court case Inspector Emma Beynon said: “The sheer amount of severe injuries that Mulla sustained are shocking – and the areas of her body affected were from her head to her tail.
“We will never know the full extent of what she had to go through and there was evidence of historic injuries on her body which showed it happened on more than one occasion.
“Her injuries tell a heartbreaking story of a dog who was repeatedly treated in a horrendous way which would have caused her so much pain and suffering."
She added that the case will “haunt” her and her colleagues for a long time.
“I hope the sentence sends out a strong message that animal abuse will not be tolerated in our society and if prosecuted, those will face severe punishment,” she said.
