POCSO amendments have barely had any impact, reporting remains low (probably lesser since the inclusion capital punishment in POCSO Act in 2019). Lowering age of consent is going to be the only amendment w an impact.
@theskindoctor13 Also, wouldn't having conversations with a teenager who is making risky decisions about sex be better than subjecting them to medical examinations to determine their age - regarding your last para?
@bullish_india@theskindoctor13 We do let them do things like say drive a two wheeler, or refuse a medical examination. This is about recognising 'evolving capacities', not treating 16 year olds the same as 10 year olds.
@theskindoctor13 Sir, do you realise that right now even talking to a 16 year old about the risk of STDs could be made to look like an offence under POCSO? Since sex at 16 is 'criminal' how can you educate teens about safety, consent and autonomy?

How wonderful to read about transformative and restorative justice being asked for in the context of the MIH 'Dalit-Buddhist wedding' episode controversy. Caste would indeed be the ultimate litmus test for achieving transformative justice in India.
P.S. I have used he/she in some places and 'she' in others bec POCSO is gender neutral but IPC is not. 'Rape' under IPC applies only to female victims. So for men above 18 years, no clear law on sexual assault, only section that could be used is S. 377 on 'unnatural offences'.
I am really surprised at how dangerously misleading this post is. Any first or second year student of criminal law could tell you, that if the survivor says she/he did not give consent, then a case of sexual assault/rape is made out. There can be no 'blanket exclusion'. 1/n
'Lowering the age of consent' to 16yrs would mean a blanket exclusion of 16-18yr old children from the protection of law against child sexual abuse (POCSO Act). Practically, it would mean that a 50y old man can commit several forms of sexual assault with a 16 year child.. (4/21)
By all means, let us have a broad based discussion on how we can recognise consensual sexual activity b/w adolescents AND ensure we are addressing child sexual abuse and issues like grooming and manipulation. But let us not create unreasonable fears that vitiate discourse. n/n
