A whole lot of the investors freaking out claiming the SEC is involved in overreach no one could have foreseen refused to invest in my project because we wouldn't do an ICO. Not only that but they claimed that being a normal company accepting equity investment and doing an honest prefarm was even more dangerous than doing an ICO and engaging in convoluted machinations to wind up with token but be able to claim you didn't give them to yourself.
Look people, this isn't complicated: There are laws against generating a bunch of hype and dumping your investment on retail ASAP before the market has had a chance to figure out whether you've built anything of actual value. On top of that there are rules against doing sketchy shit to get around the first set of rules. You can't get around it by going to the New Innovations In Sketchy Shit conference and taking the latest ideas and having a lawyer draft an opinion saying that the laws only apply to Old Sketchy Shit and not your New Sketchy Shit.
