I'm confused by this. The statute that lays out the procedure by which the Senate can make a referral to the DOJ for contempt of Congress says that only the president of the Senate can make the referral, and that after it's been approved by the Senate.

That hasn't happened here - Paul is making the referral himself. The DOJ therefore has no grounds to prosecute, since the Senate has not held that Fauci is in contempt of Congress.
