In the PLR Annual Volume's latest piece, Preliminary-Hearing Waivers and the Contract to Negotiate, Michael Cicchini explores plea offers under which prosecutors promise to engage in future plea negotiations if a defendant waives a preliminary hearing. /1

But typical remedies for plea-bargain breaches don't fit in these circumstances. Instead, Cicchini argues, breaches of preliminary-hearing waiver offers should be treated as a failure to prosecute. Cicchini then describes several possible remedies and provides a model motion. /3
