Because they're not going to set a rule that requires a specific mph wind to allow a 12th man to hold the ball. So yes, it makes sense to not allow wind to dictate when. They just didn't think of "dirty kicks" being a thing to be exploited. It happens. You try to think of every situation, but there will always be times when a loophole is found. This isn't the first or even tenth time a team has found a loophole.
