@nicholasdeorio I don’t think he’s saying to do that, I think he’s saying Ben should not be saying things like “I technically meet all the elements of stalking” or speaking with the cops because there is a 1000% chance that will be used against him in his criminal case.
Hot take? Cornyn endorsing the Libertarian would be better for Talarico than Cornyn endorsing Talarico. A lot of Cornyn supporters would rather eat bricks than vote for a Dem. A libertarian however... Is another story.
@zkwerrell@itskikidanger The only reason why is because of 50 years of horrible conservative Supreme Court precedent that shield bad cops when they violate the constitution though.
I’m one of the more skeptical people when it comes to whether Ben will get out of those criminal charges but yeesh this is terrible police work. This is what happens when “Back the Blue” supporters control cops for 50 years. Complete incompetence.

@IamR0galD0rn That’s the thing though. If they can frame it as “we were conversing about what the law means” and they can get a judge to believe it was reasonable to think that, then they are entitled to QI. I am for getting rid of QI btw, it has done nothing but shield incompetents.
@someguy595@ShakeDrizzle I should not quotes are paraphrasing, probably should have confirmed first. I can find the statute if you want the actual language.
@someguy595@ShakeDrizzle He did say that, but he didn’t read the whole statute, which requires a “reasonable person in the victim’s position.” But yeah probably a jury question there.
@WillLewis_1976@SirScoots@johnbryanesq Not just character impeachment. Probable cause is a defense for both Unlawful Arrest and First Amendment retaliation, so a conviction would lead to not being able to sue the cops under those causes of action.
