New York Governor @KathyHochul is about to replace "mother" with "gestating parent" and "father" with "non-gestating parent" in state law.
The move mirrors the language used by @BradHoylman, a gay state senator who bought his two daughters via surrogacy contracts.
Hoylman, who has spoken at events for gay male surrogacy advocacy group Men Having Babies, wrote and sponsored the Child-Parent Security Act, which legalized gestational surrogacy in New York in 2020.
The CPSA completely removed the legal designation of "mother" from the person giving birth if a contract is in place.
For example, the Family Court Act (for judgment of parentage of a child conceived through assisted reproduction) states:
"In cases where there is a non-gestating intended parent, a statement from the gestating intended parent and non-gestating intended parent that the non-gestating intended parent consented to assisted reproduction..."
The newer bill is what seeks to take those "gestating" concepts from the CPSA and apply them more broadly across all New York state laws, replacing general instances of "mother" and "father" with "gestating parent" and "non-gestating parent."
The memo for S.9316 explicitly notes that it is following the lead of Hoylman's Child-Parent Security Act (CPSA).
It states that because the CPSA successfully introduced gender-neutral mechanics to establish "parentage," this newer bill aims to update terms like "paternity," "filiation," "mother," and "father" across the rest of New York state statutes to keep the laws consistent.
