Sifting through the details of this rush-job of a national security law: its packed with ambiguities. Some deliberate, designed to maximise the state’s coercive power and room for maneuver. Others that might just be sloppy drafting.
And there are SO MANY open questions about how this will work – questions about evidentiary rules, procedural standards, disclosure of information to accused persons, appeals - that should keep criminal defence lawyers (and, frankly, fair-minded prosecutors) up at night.
