FAMILY MEMBERS SENTENCED TO THREE AND SIX MONTHS OR TO PAY A FINE
@NPA_Prosecutes statement
The Polokwane Magistrate’s Court has convicted and sentenced Shezaad Chaya (32), Shamoon Chaya (56) and Mohamed Chaya (27) for the assault and malicious damage to property on Arshad Chaya and his sibling. During the incident on 20 July 2021 Arshad was an Acting Magistrate at Mankweng Magistrates’ Court.
During the trial, the accused pleaded not guilty to the charges, as the trial progressed they then decided to make admissions and alter their plea to that of guilt. Then the court convicted all three of them based on their admissions.
In court the video of the incident was presented as evidence depicting the whole incident unfolding. The video shows how the accused persons assaulted the complainants as well as the damage to the property. This happened at the homestead of the complainant at Nirvana-Polokwane.
In aggravation of the sentence, advocate Andisa Vavilova Mudau submitted that the offences were violent in nature, and it was clear how the attack was carried-out on the victims. He further said that it was senseless as Shamoon Chaya (accused two) also attacked a defenseless female victim. Accused two is the father to the co-accused persons and he is also an uncle to the victims.
In mitigation of sentence advocate Barry Roux conceded that the accused have been convicted of the offences that entail an element of violence, however, the court must be lenient when passing sentence as they are first offenders, and they are remorseful of their conduct.
The court gave the accused a sentence with an option of a fine partially suspended for a period of five years. Shezaad was sentenced to six-month imprisonment or a fine of R6000, Shamoon was sentenced to 12 month or a fine of R12 000 and Mohamed was sentenced to six month imprisonment or pay a fine of R6000
The National Prosecuting Authority welcomes the sentence and applauds the good work done by Adv. Mudau Andisa and investigating officer, sergeant Mashele of Polokwane Provincial Office.
